Novara Law Firm Obtains Second "No Cause" Verdict in a MonthÂ
Novara Tesija & Catenacci, PLLC (NTC) announced today that attorneys Timothy Kubik and Jason Baas recently obtained a “no cause” jury verdict for their insurance industry client in Oakland County, MI before Judge Michael Warren.
Plaintiff, an individual, sought $1.2M in outstanding medical bills, lost wages, attendant care and replacement services. Plaintiff argued that a high-speed car accident caused an exacerbation of his underlying neck and back conditions, resulting in a cervical discectomy and fusion. The defense argued that Plaintiff failed to disclose his pre-accident history to the insurance company, his own doctors, and independent medical evaluators. The defense was also able to uncover a domestic incident that occurred in Florida during the time Plaintiff was claiming 24/7 attendant care.
After a six-day trial, including seventeen witnesses, the jury found that the Plaintiff had committed fraud in pursuit of his First-Party No-Fault benefits and rendered a verdict of “No-Cause of Action.”
