Novara Law Obtains Favorable Trial Result in Wayne County Circuit Court

Novara Law recently prevailed in a six-day No-Fault jury trial in Wayne County Circuit Court. Novara attorneys Jillian Peterson and Timothy Kubik represented an insurance carrier in a suit brought by an insured who claimed that the carrier wrongfully denied benefits related to a 2019 auto accident. 

At trial, the plaintiff alleged that he sustained serious injuries to his head, neck, back, shoulders, and hips, and testified that he was disabled as a result of his accident-related injuries. His attorney requested over $250,000 in damages, including medical bills, attendant care, household chore assistance, and work loss.  

In response, the Novara legal team contended that the carrier had paid all reasonably necessary benefits, pointing out that the plaintiff’s medical records and imaging studies did not identify any serious injuries. They also presented testimony from independent physicians, who had examined plaintiff and his medical records and were unable to find any objective sign of injury related to the accident.

The jury ultimately agreed that the plaintiff’s claims were excessive and awarded only $5,600 in wage loss benefits, amounting to 2% of the damages claimed. The jury did not award any medical bills, attendant care, or household chore assistance.
