Sixth Win in Six Months for Novara Law Insurance Defense Team
Novara Law Senior Partner Marc McDonald and Associate Jenna McKenna recently obtained a no-cause verdict in Macomb County Circuit Court – the sixth win in six months for the firm’s Insurance Defense legal team.
Plaintiff and medical provider plaintiff sought over $100,000 in damages in a case involving claims for medical bills, lost wages, and replacement services. Plaintiff alleged that the treatment was related to a 2019 accident in which her vehicle was hit head-on, causing extensive damage.
At trial, the Novara Law team exposed that the plaintiff sustained only minor injuries – using surveillance footage and IME expert testimony to defend the claim, highlighting multiple fraudulent statements made by plaintiff in the pursuit of no-fault benefits. Ultimately, the team argued that the treatment rendered by various medical providers was unreasonable, unnecessary, and merely done to exploit Michigan’s no-fault system.
At the end of a long five days, the jury agreed that the plaintiff did not require ongoing treatment beyond what the national insurance carrier had already paid, and therefore was not entitled to any further PIP benefits. The jury further concluded that the plaintiff was not entitled to any wage loss at all, and that nothing was owed on the almost $50,000 bill claimed by provider plaintiff.
